@Nomnom111 What do you want to happen next? Maybe just laugh and figure you have a story to tell. You might consider not considering suggestions regarding legal issues from anyone other than someone who has reason to believe they know what they are talking about, i.e., an attorney. And they are not cheap. One hour of attorney time could buy several good toys, and then there is the value of your own time.

I was simply suggesting that it’s easy to follow up on. Whether that’s a mental note, police report, attorney, or none of the above is on them.
Obviously they can do whatever they want, but knowing the option is there can’t be a bad thing.
I just wanted Nomnom111 that this sort of thing is rare, but that it’s the kind of thing that could shock and piss off anybody, and that they have every right to sort it out how they feel is best.

@SeverinYourServant What option is there? Federal crime was mentioned without citing a section of US Code that it makes it a crime to open a package not delivered by the US Post Office. After a package has already been delivered, how does opening a package impact interstate commerce enough to give the federal government jurisdiction? How many agents does the FBI have free to investigate opened packages? How many United States District Attorney's would commit their limited resources to the possibility of calling up a Federal Jury to try someone for opening a package? Even if that was somehow a priority, how could a DA prove beyond a reasonable doubt that a defendant realized a package delivered to his door was not his package? I personally have never checked the label of a delivery from TD before opening it. TD mentioned DSL which does not sound like FedEx which suggests the possibility here that this package might have been delivered outside the territorial jurisdiction of the US. How does covid 19 affect the legal status of a package? How does theft also apply here?Giving something back is the opposite of theft. Theft is the taking of the property of another with the intent to permanently deprive them of the use of that property. No, it is not easy to follow up with anyone other than the shipper who might offer some minor recompense.

This boy talking about the FBI.
First note: nowhere prior to your input were lawyers referred to, as the likelihood of their involvement is not high with the simple filing of a police report. I only said that if they went that route, it would likely be a simple case.
DHL and private carriers are not federally covered, after reviewing the protections on mail. That said, it is generally in the deliverer’s interest to retain records of addresses of deliveries, so such records can be referred to should legal matters arise.
Returning property isn’t an opposite to theft, especially when it is done after maliciously damaging personal property.
First, it constitutes petty theft, by legal definition, as the product was opened and intentionally put to the taker’s use (putting their fingers inside). This may vary slightly in some states, the most common variation being the intention to permanently deny someone of personal property. One is not recused of theft simply by returning intentionally misappropriated property.
As a collector’s note, intentionally devaluing a product by any means constitutes property damage, and typically is classified as vandalism.
These are very basic, very provable crimes, especially as the prior recipient included a clearly malicious note. (As a side note, I find it odd that DHL didn’t bother checking the condition or contents of the returned package.)
It’s very simple to file a police report. Bare minimum, you get the satisfaction of ruining somebody’s day (fair, considering the circumstances). Most crimes don’t go to court, and I’m sure that if OP wanted to press charges, they would likely reach a satisfactory settlement.
I don’t know where you get your information from, but crimes falling into misdemeanor territory don’t typically go before a jury, don’t involve lengthy investigations, can typically be investigated by local law enforcement, and, should charges be filed, generally requires the defendant to appear in the local court of the area in which the charges were filed. Failing to make an appearance in court almost always results in automatic victory for the prosecution, so if they happen to be out of state, they would definitely prefer to settle, rather than pay to be publicly embarrassed.
That aside, my man, where are your teeth? I don’t know about you, but the last time somebody spat in my face, I had to bandage my knuckles. Beyond the respect I kept for myself, I’m making plans to have drinks with the same bastard after our vaccinations.

As for sources of information, the use of the following seem better than petty insult and implied threat: any dictionary, before using a word like "recused", Barron's Law Dictionary, 5th Edition, Wikipedia, Statutes, Cases, Law Review articles, 9th grade Civics, ............ Logic taken at university is a good tool for use. Battery, which can result in bloody knuckles, is historically a common law misdemeanor, and results in harsher sentences than misdemeanor package opening.....

The terminology I referenced came from the Wex legal dictionary, so...
Also, trying to turn obvious context into some boorish threat for the sake of pretending to be attacked is adorable.
Don’t be mad because you had to look up ‘recused.’
You clearly have absolutely no social experience. If a punkass hawks in your face in a punk bar, and you choose to take exception, everybody in there is going to become a witness in your defense if you end up needing them to be.
My point is that it’s not worth walking through life with no pride. If you aren’t feeling personally attacked, then you’re welcome to ignore whatever you want to put up with. The moment someone crosses a line that you won’t stand for them to cross, then you have to stick up for yourself, to whatever degree (within reason) you feel wronged.
Say what you want. I’m done giving you the attention you’re clearly looking for.

Filing a report was all I was suggesting. I’m not sure how much of the above nonsense is worthwhile to you, but the legal definition for vandalism should be relatively the same.
Good luck.

@Nomnom111 Opening someone's mail and damaging it is still illegal in Canada, I too would recommend consulting your legal options because that kind of thing would piss me off as well.

@Nomnom111 Sorry that happened to you. Please contact customer service with additional information and we'll see if they can check with DHL to see what happened.

@Nomnom111 my situation is slightly similar, my package got misdelivered yesterday and I'm waiting for it to get returned to me with a note inside like you or i can't get it back cause the person stuck their dick in it and is keeping it meaning that i spent $50 for another dudes pleasure. sometimes i wish they just double check the address before dropping it off.
BogeyB ( 38 )
@FutaLover1 Some people don't want that happening to them and won't open your package. Did you request that the packaging be removed from your items? If not, the packaging for the toy is usually sealed in some sort of plastic, and especially the toy itself. If you don't see any plastic, that does raise some red flags.
I'll admit that I've opened a package before that wasn't mine. I was expecting a package already which was marked Delivered, and I had one package in my mailbox, so I took it home, cut it open, lifted the cardboard flaps, and slammed shut when I realized I didn't recognize an item or two in my package.. I looked at the address, and it was for my next door neighbor. After a loud internal scream, I sealed it neatly and carefully back up with packing tape, and ran to my neighbor's house, dropped it off, rang the doorbell, and ran like a deer. [My package was delivered the next day. Not the first time where I didn't get my package after marked as delivered, and I see it dropped off by the shipping carrier the next day.] Anyways, ToyDemon's packages have always been a little better at ensuring nothing's gone into it before getting to you. Like, I've always had label for the package put where it NEEDS to be to be cut for the box to be opened. So if I had tried what I did with my neighbor's package to a ToyDemon package, there'd be a giant red flag when the label has a big slice through it. I mention all that though, to emphasize the plastic sealing on the individual toys being the main thing I'd be concerned with.
"...cause the person stuck their dick in it and is keeping it..." If they stuck their dick in it, I don't think you're gonna want them to send it to you. The topic creator just got a hand, and judging from the heart on the note, it looks like the hand of a female or a gay guy. I still wouldn't trust either one. However, it sounds like you're imagining the worst situation to come from this, which I know I would be doing the exact same until downright obsessing about it, but it's just not going to help. I saw you already contacted ToyDemon's customer service about it, so I'd say: rest assured that you'll [eventually] get the package you ordered without any dicks having passed through it, but it may take some extra time to receive it than you had anticipated, depending on how significant the issue becomes.
And yeah, shipping companies policies cause crap like this. I've heard Fedex deliverers have 30 seconds to be back in their truck after making a stop for a delivery. I completely agree that I wish they would take a few seconds to verify they're at the right place, but they'll just be fired if they try too often to ensure it's getting to the right spot. This isn't just Fedex either, UPS was getting a lot of heat for a while with drivers pissing in Gatorade bottles in their trucks because they felt they had ABSOLUTELY no time to stop somewhere. This isn't meant to stop you from being pissed off at Fedex, but maybe it kind of helps knowing something like this wasn't just the driver trying to be malicious. When you have companies ensuring your package will be delivered before they ensure their employees get bathroom breaks, it's no surprise to hear about things like the recent shooting at the Indianapolis Fedex hub. At the same time, Unions are usually corrupted bullshit, so I donno what the right answer is here.
Anyways, I hope for the best for you, and that you get your package soon, still sealed.

Damn. I mean, they should at least have the prior delivery address on record (I actually believe this is a requirement for deliveries). As long as that’s the case, if you want to follow up on legal action, it shouldn’t be difficult.
This is still one of those 0.01% situations that I’m sorry you had to put up with. Based on the picture, I’m guessing that’s the MagicFace, so it’s even worse, considering it’s a more expensive, generally less-stocked item.
I hope this gets resolved quickly and cleanly for you.

If they opened your mail, it’s a federal crime. Intentionally compromising something intended for personal use counts as destruction (not just theft, although that also applies here) of property. As it’s a pandemic right now, there are also health and safety considerations.
Obviously, you should follow ToyDemon’s advice. But you should also contact the proper authorities, because the moron who opened your package is definitely liable to see heavy fines, potentially house arrest, and even jail or community service. Beyond that, it would be an open and shut case if you brought it to court, meaning you’re likely to see them pay you damages.
I’m sorry that this happened to you. Some people aren’t worth the air they breathe.
